1. Acceptance of Terms
By accessing or using the Automate mobile application and website (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use our Services.
These Terms constitute a legally binding agreement between you and Automate ("we," "our," or "us") regarding your use of our Services.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Not be prohibited from using our Services under applicable laws
- Provide accurate and complete registration information
3. Description of Services
Automate provides a platform that connects vehicle owners with automotive service providers ("Workshops") for car repair, maintenance, and related services. We act as an intermediary and do not provide automotive services directly.
3.1 Our Role
- Connecting users with verified Workshop partners
- Facilitating online booking and payment processing
- Providing communication tools between users and Workshops
- Displaying reviews and ratings
3.2 What We Don't Do
- We do not perform automotive repairs or services ourselves
- We do not guarantee the quality of Workshop services
- We do not employ the Workshop staff
4. User Accounts
4.1 Registration
You must create an account to use certain features of our Services. You agree to provide accurate, current, and complete information during registration and keep it updated.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect unauthorized access to your account.
5. Booking & Payments
5.1 Booking Process
When you book a service through our platform, you enter into a direct agreement with the Workshop for those services. Automate facilitates but is not a party to this agreement.
5.2 Pricing
Prices displayed are set by the respective Workshops. While we strive for accuracy, we do not guarantee that all pricing information is error-free. Additional charges may apply for extra work discovered during service.
5.3 Payment Terms
- Payments are processed through secure third-party payment providers
- Full payment or deposit may be required at the time of booking
- All fees are in UAE Dirhams (AED) unless otherwise stated
5.4 Cancellations & Refunds
- Free cancellation up to 24 hours before the scheduled appointment
- Late cancellations may incur a fee as specified at booking
- No-shows may be charged the full service amount
- Refunds are processed within 5-10 business days
6. Workshop Partners
6.1 Verification
We verify that Workshops have valid UAE trade licenses. However, we do not guarantee the quality, safety, or legality of their services.
6.2 Ratings & Reviews
Users may rate and review Workshops after completed services. Reviews must be honest, accurate, and based on genuine experiences. We reserve the right to remove fake or inappropriate reviews.
7. User Conduct
You agree NOT to:
- Provide false or misleading information
- Use the Services for any illegal purpose
- Harass, abuse, or harm others
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the Services
- Scrape, copy, or collect data without authorization
- Post spam, advertisements, or malicious content
- Impersonate another person or entity
8. Intellectual Property
All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, and software, are owned by Automate or our licensors and are protected by UAE and international intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY UAE LAW:
- AUTOMATE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES
- WE ARE NOT LIABLE FOR THE QUALITY, SAFETY, OR OUTCOME OF SERVICES PROVIDED BY WORKSHOPS
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS
- WE ARE NOT LIABLE FOR ANY LOSS OR DAMAGE TO YOUR VEHICLE WHILE AT A WORKSHOP
10. Indemnification
You agree to indemnify, defend, and hold harmless Automate, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Services or violation of these Terms.
11. Dispute Resolution
11.1 Between Users and Workshops
Disputes regarding service quality or pricing should first be addressed directly with the Workshop. Automate may assist in mediation but is not obligated to resolve disputes.
11.2 Between Users and Automate
Any disputes arising from these Terms shall be governed by UAE law and subject to the exclusive jurisdiction of the courts of Dubai, UAE.
12. Modifications to Services
We reserve the right to modify, suspend, or discontinue any part of our Services at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Services.
13. Termination
We may terminate or suspend your account and access to the Services at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, Workshops, or Automate.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and in the app. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
